Woman sues over fungal eye infection allegedly caused by pharmaceutical injection

GRETNA – A Jefferson Parish couple is suing a pharmaceutical company for injuries she claims to have received from an injection of one of its products into her eye.

Susan Kappelman, and husband Frank Kappelman, M.D., filed suit against Wells Pharmacy Network, LLC and Franck's Compounding Lab in the 24th Judicial District Court on Aug. 24.

Kappelman claims that due to an eye condition she had an injection of Brilliant Blue G into her eye and that shortly afterward she experienced progressive vision loss, pain and other disorders. The plaintiff alleges that lab tests revealed a fungal infection in her eye and that Brilliant Blue G was pulled from the market due to reports of numerous patients experiencing fungal eye infections.

Kappelman asserts that she has suffered profound and permanent injuries to her right eye due to the injection of the defendant's product.

The defendant is accused of designing and making a defective and unreasonable dangerous product, failing to comply with express or implied warranties, failing to maintain appropriate sterility and sterile technique and failing to maintain quality control procedure.

An unspecified amount in damages is sought for pain and suffering, mental suffering, loss of wages, medical expenses, permanent disability, vision loss, loss of enjoyment of life and loss of consortium.

The Kappelmans are represented by Joseph S. Piacun of Metairie-based Gennusa, Piacun & Ruli.

The case has been assigned to Division P Judge Lee V. Faulkner, Jr.
