Gretna resident suing 42 companies for alleged exposure to asbestos

NEW ORLEANS - A Gretna man is suing 42 entities listed as asbestos miners, manufacturers, sellers, suppliers and distributors alleging they're responsible for his exposure to asbestos and subsequent contraction of malignant mesothelioma.

Byron Boudreaux filed suit against Avondale Industries, Crane Co., Eagle Inc., Foster Wheeler Energy Corporation, Hopeman Brothers Inc., McCarty Corporation, Reilly-Benton Company, Riley Power Inc., Viacom, Inc., Uniroyal Inc., Asbestos Corporation Limited, Crosby Valve Inc., Fairbanks Morse Pump Corporation, FMC Corporation, Goulds Pumps(IPG) Inc., Ingersoll Rand Company, Peerless Industries Inc., Warren Pumps, Inc., Sterling Fluid Systems(USA), Viking Pumps, LLC., Weir Valves & Controls USA, Inc., Yarway Corporation, Taylor-Seidenbach, Inc., Metropolitan Life Insurance Company, Owens Illinois, Inc., International Paper Co., Union Carbide Corporation, Maryland Casualty Company, Bayer Cropscience Inc., Liberty Mutual Insurance Company, Houston General Insurance Company, The Stone Wall Insurance Company, First State Insurance Company, American Insurance Co., Home Insurance Company, American Motorist Insurance Co., Onebeacon Insurance Co., Highlands Insurance Co., The Travelers Insurance Co. and Certain Underwriters at Lloyd's, London in the Orleans Parish Central District Court on Aug. 9.

Boudreaux alleges that his recent diagnosis of malignant mesothelioma is a result of exposure to injurious levels of asbestos by way of contact with products manufactured, sold, supplied or used by the listed defendants.

The defendants are accused of failure to warn the petitioner of the hazards of the products, failure to test the products for defects, failure to recall the products and lack of safety instructions.

An unspecified amount is sought for all damages including medical cost, lost earnings, mental suffering, pain and suffering, loss of quality of life, and past, present and future disability.

The plaintiff is represented by David R. Cannella of Landry, Swarr, & Cannella L.L.C.

The case has been assigned to Division D. Judge Lloyd J. Medley.
