NEW ORLEANS – A Wisconsin man is suing a Bourbon Street bar for injuries he claims to have received while being restrained by a bar employee.
Herbert Bergson filed suit against Funky 544, LLC, Dennis Cameron and their insurer in the Orleans Parish Civil District Court on Sept. 18. Bergson claims he was walking down Bourbon Street with his traveling companion Ellen Despins when he bumped into Cameron while passing in front of Funky 544. The plaintiff claims that Cameron ordered him to stop walking and that when he continued Cameron forcibly restrained him with a bar key causing a laceration to his face. Bergson asserts that he received 51 stitches to close the wound allegedly caused by Cameron.
The defendant is accused of failing to properly train its employees, failing to properly screen employees prior to hiring them, failing to perform job in prudent manner and failing to exercise reasonable care in the performance of employment.
An unspecified amount in damages is sought for medical expenses, permanent scarring, pain and suffering, loss of income and loss of enjoyment of life.
