BATON ROUGE – A Baton Rouge woman is suing a local Wal-Mart after one of its employees allegedly improperly bagged her merchandise, causing injury.

Jenny Aligada filed suit against Wal-Mart and an unnamed employee in the 19th Judicial Court on Oct. 9. The plaintiff claims that on April 14, 2012, while she was a customer at Wal-Mart, located at 3132 College Dr., the defendant improperly bagged her merchandise. Aligada claims the items fell on and sliced open her foot.

The defendant is accused of failing to put customers on notice as to the existence of a hazardous situation, failing to provide and maintain a safe premises and failing to take proper safety precautions.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental anguish, emotional distress and residual disability.

The plaintiff is represented by Kelly E. Balfour of Law Offices of Ossie Brown.

The case has been assigned to Division F Judge Timothy Kelley.
