GRETNA – A Jefferson Parish woman is suing a local retailer for injuries she claims she received when someone attacked her on its premises.
Julie Johnson, wife of Ted Johnson, filed suit against Wal-Mart Stores, Inc., Wal-Mart Louisiana, LLC, its insurer, Daniel Paterson, an unknown security manager, an unknown security guard and an unknown battery perpetrator in the 24th Judicial District Court on Sept. 4.
Johnson claims she had been shopping at the Wal-Mart located at 4810 Lapalco Blvd. in Marrero and as she left she was assaulted, robbed and battered by the unknown perpetrator.
The plaintiff alleges that the security manager and security guard on site were aware of the foreseeable violence in the parking lot.
Johnson asserts that the defendants were responsible for her protection while on their premises. The plaintiff alleges the defendants allowed the perpetrator to rob and assault her.
The defendant is accused of failing to keep a proper lookout, failing to see what should have been seen, failing to act in a reasonable manner, failing to warn plaintiff of the risk, failing to prevent the foreseeable violence, violation of state law, breach of duty of protection, respondent superior, vicarious liability, failing to prevent an act which caused damage, failing to properly supervise its employees, negligence and breach of duty of protection.
An unspecified amount in damages is sought for pain and suffering, mental anguish and suffering, medical expenses, loss of wages or earning capacity, disability, loss of bodily function, physical impairment, psychological distress, loss of enjoyment of life, punitive damages, inconvenience and ambulance.
