Business struck by lightning suing insurer

GRETNA – A Jefferson Parish business owner is suing his property insurer for not providing a full claim on equipment that was allegedly damaged in a lightning strike.

Jamie B. D'Amico and 100-106 Airline, LLC filed suit against Colony Insurance Company in the 24th Judicial District Court on Sept. 25.

D'Amico claims that a trailer located at 100 E. Airline Drive in Kenner was struck by lightning on Sept. 26, 2011 and caused severe damage to his businesses equipment including the telephone system, computer hardware and software and personal property. The plaintiff alleges that the defendant began adjusting the claim but did not provide full payment of the plaintiff's losses.

The defendant is accused of providing only partial payment, arbitrarily and capriciously failing to provide full payment and violating state law.

An unspecified amount in damages is sought for full payment for damages that should be covered under the insurance policy.

D'Amico is represented by Angelina Christina of New Orleans-based McGlinchey Stafford, PLLC.

The case has been assigned to Division M Judge Henry G. Sullivan, Jr.
