Seaman seeks $1.6 million after falling through unbolted manhole cover

NEW ORLEANS - A seaman has filed a lawsuit seeking $1.6 million claiming he stepped on an unbolted manhole cover, which gave away and caused a back and neck injury.

Jimmy Covington filed suit against L. L. & G. Construction Inc. on Oct. 22 in federal court in New Orleans.

The alleged incident occurred on Oct. 8, 2012 as Covington was walking to the starboard side of the M/V Sea Constructor looking for a mooring line.

The defendant is accused of negligence for failing to provide Covington with a safe place to work and with an inadequately trained crew who could have avoided his injuries. Covington states that the vessel’s owners are negligent for having a defective and unbolted manhole in the area of pedestrian traffic.

The plaintiff is asking for an award of $1.6 million damages for medical expenses, lost wages, pain and suffering, mental anguish, emotional stress and strain, loss of enjoyment of life, loss of earning capacity, interest, maintenance and cure.

Covington is represented by New Orleans attorney Darleen M. Jacobs.

U.S. District Judge Eldon E. Fallon is assigned to the case.
