NEW ORLEANS - The New Orleans VA Hospital is being sued by a visitor who claims she slipped and fell due to a wet floor.
Mary Alicia Connelly filed suit against Veterans Administration Hospital on Nov. 2 in federal court in New Orleans.
The alleged incident occurred on Feb. 3, 2011 as Connelly was at the Veterans Administration Hospital in New Orleans with her brother.
Connelly states that she was approaching the nursing station on the third floor, when she slid across the hall and fell due to a foreign substance located on the floor.
According to the lawsuit, a maintenance man had immediately mopped the floor before her fall.
Connelly argues that the premises of the VA Hospital was defective and constituted a premises defect. She claims that the defendant knew or should have known of the defective condition and that her fall, was caused by the premises defect.
The plaintiff is seeking an award of damages for pain and suffering, medical expenses, mental anguish, loss of enjoyment of life, disabilities, loss of mobility and function, loss of employment, loss of earning capacity, miscellaneous expenses required in traveling to and from North Carolina for medical care from her prior Orthopedic Surgeon, and interest.
Connelly is represented by J. Michael Daly, Jr., Bradford H. Walker, and Steven Jay Irwin of Walker Daly in Metairie.
U.S. District Judge Nannette Jolivette Brown is assigned to the case.
