Tape allergy leads to lawsuit against Tulane Medical Center

NEW ORLEANS – A Baton Rouge man is suing the Tulane Medical Center and several related entities for alleged damages resulting from the application of tape/adhesives to a surgical wound area.

Erik L. Stoks filed a lawsuit against Tulane Medical Center, nurses, physicians and staff who provided care during his admission, Fernando Sanchez, M.D. Surgeon, Andrew Tarleton, M.D., Hollie H. Davis, R.N. and Joey G. Poiencot, R.N. in the Orleans Parish Central District Court on Aug. 23.

Stoks, recipient of a total knee replacement of the right knee, claims that the defendants, who were informed prior to surgery that he was allergic to tape, dressed the surgical site with tape to which he was allergic anyway. The plaintiff avers that as a result of the tape he had an allergic reaction causing him to develop severe blisters around the area where the surgery occurred. The tape also caused Stoks to develop a wound with skin necrosis over his right knee.

The defendant is accused of applying tape after having full knowledge that the plaintiff was allergic, failing to hire staff qualified to provide adequate medical care and failing to properly treat the plaintiff with skillful service, care and treatment.

An unspecified amount is sought for all damages, cost, and any and all general and equitable relief reasonable under the law.

Counsel for the plaintiff is Charles J. Fulda, IV of Baton Rouge-based Brouillette & Associates, APLC.

This case has been assigned to Division H Judge Michael G. Bagneris.
