Walk-On's sued after man allegedly assaulted by extra duty security

BATON ROUGE – A Baton Rouge man is suing a local restaurant after he was allegedly injured on its premises.

Ralph Turner Casey filed suit against Walk-On's Bistreaux and Bar, LLC in the 19th Judicial Court on Nov 21.

Casey claims he was a customer at Walk-On's, located at 3838 Burbank Dr. on Nov. 25, 2011. He was in the tent area that Walk-On's had provided for its patrons that night, the suit claims.

At approximately 8:40 p.m., a fight broke out in the tent, and extra duty Baton Rouge police officers, hired by Walk-On's to provide security, entered the tent to stop the fight.

The plaintiff asserts he was not involved in the fight in any way, but was simply in the vicinity where the fight broke out.

Casey claims while the officers were responding to the fight, one or more of the extra duty officers grabbed him, threw him to the ground, beat him in the face six or seven times and arrested him.

The plaintiff states he did not cause or provoke the beating in any way.

The officers are accused of negligently and forcefully beating the plaintiff in the face for no justifiable reason, failing to see the plaintiff did not cause the fight and using unreasonably excessive force against Casey.

Walk-On's is accused of hiring personnel who viciously and without any cause beat the plaintiff, creating a work environment that was acceptable for its security to assault a customer and failing to provide adequate and competent security.

Casey allegedly suffered the loss of tooth, damage to his mouth and damage to other teeth.

An unspecified amount in damages is sought for residual disability, disfigurement and scarring, physical pain and suffering, mental anguish and distress, loss of enjoyment of life, medical expenses and loss of earnings.

The plaintiff is represented by Lindsey J. Leavoy of Joubert Law Firm, APLC.

The case has been assigned to Division M Judge Kay Bates.
