Brothers Food Mart employees sue claiming they were not paid for overtime

NEW ORLEANS - Several convenience stores employees have filed a lawsuit against the store claiming they each worked an average of 30-40 hours of overtime a week that went unpaid.

Hamden on Nov. 28 in federal court in New Orleans.

The plaintiffs were hired by the defendants to work as cashiers, cooks and to generally operate stores. The employees state they worked between 70-80 hours per week for the defendants.

"However, although Plaintiffs regularly worked in excess of 40 hours per week for Defendants, they were not paid time and one-half for any hours worked in excess of 40 per week, in direct violation of the FLSA," the lawsuit states.

The defendants are accused of violating the Fair Labor Standards Act by failing to pay overtime.

The lawsuit is seeking an award of unpaid back wages, liquidated damages, lost wages, compensatory damages, interest, attorney's fees, and court costs.

The plaintiffs are represented by Jody Forester Jackson and Mary Bubbett Jackson of Jackson and Jackson in New Orleans.

U.S. District Judge Helen G. Berrigan is assigned to the case.
