Offshore worker sues for $2 million after struck by 20 pound maul

NEW ORLEANS - An offshore worker has filed a lawsuit seeking $2 million after a co-worker allegedly struck him with a 20-pound maul.

Craig Nunnery filed suit against Offshore Marine Contractors Inc. on Dec. 3 in federal court in New Orleans.

The alleged incident occurred on March 31, 2012 as Nunnery was working aboard the L/B Wyatt Lee.  A co-worker was attempting to strike the joint of pipe with the maul and struck Nunnery in the left hip/lower back. The joint of the pipe was suspended by the crane and due to the “carelessness, inattentiveness or lack of skill on the part of the crane operator,” the joint of pipe moved causing the co-worker’s hammer to strike to glance off, slip from his grip and hit Nunnery, the suit claims.

Nunnery argues that the incident was caused by the defendant’s negligence and the unreasonably dangerous condition of its vessel.

Nunnery is seeking an award of $2 million damages for loss of income, loss of enjoyment of life, medical expenses, physical and mental pain and suffering, painful and disabling injuries, interest, and court costs.

The plaintiff is represented by Berney L. Strauss and Rhett E. King of Strauss & King, APLC in New Orleans.  A jury trial is requested.

U.S. District Judge Sarah S. Vance is assigned to the case.
