Robért Fresh Market sued after woman allegedly falls on premise

NEW ORLEANS – A Jefferson Parish woman is suing local grocer after she allegedly slipped and fell in the store’s frozen food section.

Nancy L. Prieur, and husband Kenneth, filed a lawsuit against Robért Resources, LLC in the Orleans Parish Central District Court on Oct. 25. Nancy Prieur claims to have suddenly slipped and fell due to a slippery substance on the floor caused by a liquid leaking from under the refrigerated display case. She claims to have fractured her sacrum, tore the medial meniscus in her right knee and severely injured her back.

The defendant is accused of failure to keep all aisles in the store safe from all hazards, failing to inspect the store for hazards and failure to remove defective refrigerator case.

An unspecified amount is sought for pain and suffering, mental anguish, medical expenses and economic loss.

The plaintiff is represented by James T. Busenlener of Lowe, Stein, Hoffman, Allweiss & Hauver LLP.

This case has been assigned to Division F Judge Christopher J. Bruno.

Case no. 2012-10109.
