GRETNA – A St. Charles Parish landscaping company is suing a Jefferson Parish landscaping company with which it had agreed to merge.

The Landscape Group of Louisiana, Inc. filed suit against Remarkable Landscaping, LLC and Mark Busenlener in the 24th Judicial District Court.

The Landscape Group of Louisiana claims it entered into a joint agreement with Buenlener’s company Remarkable Landscaping to be named Remarkable Landscape Group. After forming the new entity the plaintiff alleges it also formed a joint bank account to be used for business deposits and withdrawals for business expenses. The Landscape Group of Louisiana asserts it soon began to notice that money was missing from the account when utility bills that were to automatically be taken out of the account went unpaid and numerous debit card transactions were discovered. The plaintiff claims Busenlener said he would provide all invoices showing the transactions were business related, but still has not done so.

The defendant is accused of paying for former business debts and contracts before the joint venture.

An unspecified amount in damages is sought for all expenses fraudulently taken out of the joint account plus attorney’s fees.

The Landscape Group of Louisiana, Inc. is represented by D. Patrick Keating of Metairie-based the Keating Law Firm.

The case has been assigned to Division K Judge Ellen S. Kovach.

Case no. 721-512.
