Seaman claims slip and fall caused by overflow of diesel from tank

NEW ORLEANS  - A Louisiana seaman has filed a lawsuit against his employers claiming they were negligent for allowing diesel to overflow the barge’s tank and causing him to slip and fall.

Michael Martin filed suit against Fab-Con and Apache Corp. (of Delaware) on Dec. 19 in federal court in New Orleans.

The alleged incident occurred on Dec. 9, 2012 as Martin was employed by defendant Fab-Con on a quarter barge in the Gulf of Mexico. Martin claims he slipped and fell in a puddle of diesel oil that had overflowed the diesel tank.

The defendant is accused of negligence for failing to provide Martin with a safe place to work and with an adequately trained crew.

The plaintiff is asking for an award of damages for medical expenses, lost wages, pain and suffering, mental anguish, emotional stress and strain, loss of earning capacity, maintenance and cure, interest, attorney’s fees, and court costs.

Martin is represented by New Orleans attorney Darleen M. Jacobs.  A jury trial is requested.

U.S. District Judge Sarah S. Vance is assigned to the case.
