Doctor sues New Orleans Federal Alliance over delay in clinic opening

NEW ORLEANS – A local doctor is suing his landlord alleging that was not able to open his new clinic on time.

Gabella Inc. and Patrick Dennis flied suit against the Federal City Retail Complex, New Orleans Federal Alliance and their insurers in the Orleans Parish Civil District Court on Nov. 14.

The plaintiff, Dr. Patrick Dennis, sought to open a medical clinic in the Federal City Development.  Dennis claims that he was led to believe that his corporation, Gabella Inc. could begin operating the clinic on Dec. 1, 2011. As a result, Dennis resigned from his position as an emergency room doctor, effective that same date. After tendering his resignation, he was informed by the defendant that he would not be able to open his clinic on Dec. 1 due to delays in development of the property.

The defendant is accused of unjust enrichment.

The plaintiff is seeking reimbursement of improvements made to the property totaling approximately $130,000.00 and compensation for the approximately $330,000 in wages lost due to his premature resignation from his previous position. Additionally, Dennis is seeking the termination of his lease with the Federal City Retail Complex.

Gabella Inc. is represented by Hugh P. Lambert of the New Orleans-based Lambert Firm.

The case has been assigned to Division A Judge Tiffany G. Chase.
