NEW ORLEANS – A New Orleans man is suing Westend Capital Management and its managing member for damages following a supposedly frivolous lawsuit being filed against him by Westend.

Medlock Harbison filed a lawsuit against Westend Capital Management, LLC and Sean C. Cooper in the Orleans Parish Central District Court on Nov. 13. Harbison claims that the lawsuit against him citing misappropriation of confidential and trade secrets, unfair trade practices, violation of the computer fraud and abuse act and torturous interference with business relations were filed without probable cause and with malice.

The defendant is accused of damaging the plaintiff’s reputation, abuse of process, intentional infliction of emotional distress, enrichment without cause and detrimental reliance.

An unspecified amount is sought for lost wages, general damages, loss of enjoyment of life and all attorney’s fees and costs.

The plaintiffs are represented by Barry W. Sartin, Jr. of Frischhertz, Poulliard, Frischhertz & Impastato, LLC.

This case has been assigned to Division C Judge Sidney H. Cates IV.

Case no. 2012-10570.
