Entergy sues New Orleans Sewage & Water Boardcity agency for property damage

NEW ORLEANS – An energy corporation is suing a New Orleans city agency accusing them of damaging their facilities. 

Entergy New Orleans filed suit against the New Orleans Sewage & Water Board in the Orleans Parish Civil District Court on Jan. 8. The suit alleges that on Jan. 13, 2012 the Sewage & Water Board caused damage to Entergy facilities at Howard Ave. and Jefferson Davis Pkwy. Reconstruction costs totaled $37,896.27.

The defendant is accused of negligent destruction of property belonging to the plaintiff, failing to inspect a work area, failing to contact plaintiff to ascertain the location of existing facilities prior to beginning to work on the project and failing to maintain proper control of its construction equipment.

Damages are sought to cover the cost of the repairs and reconstruction.

Entergy is represented by W. Scott Brown and Sandra Diggs-Miller of New Orleans.

The case has been assigned to Division D Judge Lloyd J. Medley.
