GRETNA – A North Carolina man is suing a national retailer after allegedly walking face first into a clear glass display and injuring himself.
Ba Tran filed suit against Macy's Corporate Services Inc. and Macy's in the 24th Judicial District Court.
Tran claims he was shopping at the Macy's located at 3301 Veterans Memorial Blvd. in Metairie when he walked face first into a heavy glass display in the middle of the aisle and fell to the floor. The plaintiff alleges that the display was made of clear glass and it was difficult to see. He claims he suffered a gash to his right eyebrow, which required stitches, and neck and back injuries.
Tran asserts he was in no way responsible for the incident.
The defendant is accused of failing to do what should have been done, failing to keep a clear pathway at all times, disregarding the safety of others, failing to notice the imminence of an accident and take necessary precautions to avoid it, creating a trap for the petitioner maintaining a defective or dangerous premises and failing to warn of the dangerous nature of the premises.
An unspecified amount in damages is sought for medical treatment, medical expenses, pain and suffering, emotional distress and lost wages.
Tran is represented by Robert W. Grant of Gretna-based Grant & Barrow.
The case has been assigned to Division D Judge Walter J. Rothschild.
Case no. 723-380.
