Harvey McDonald’s sued by woman over son's playground head injury

GRETNA – A Jefferson Parish woman is suing a local fast food restaurant for serious injuries she claims her son received in a fall on a playground at the location.

Stacy Galindo, individually and on behalf of her minor child, filed suit against McDonald’s Restaurants of Louisiana Inc. and Gallagher Bassett Servics Inc. in the 24th Judicial District Court on Feb. 19.

Galindo claims her seven-year-old son was playing in the playground area of the McDonald’s located at 140 Lapalco Blvd. in Harvey when he slipped on a ramp, fell backwards and his head struck a metal pole. The plaintiff alleges that directions at the playground instructed her son to take off his shoes and that the fall was caused by his socks slipping on the plastic surface of the ramp. Galindo asserts that her son suffered mental and cognitive injuries and mental and emotional distress.

The defendant is accused of failing to exercise reasonable care and negligent construction, design, manufacture and care of playground equipment.

An unspecified amount in damages is sought for personal injury, loss of consortium and attorney's fees.

Galindo is represented by Jody Forester Jackson of New Orleans-based Jackson+Jackson.

The case has been assigned to Division I Judge Nancy A. Miller.
