GRETNA – A Mississippi company is suing a Harvey-based subcontractor for allegedly not paying for materials used in the construction of a local levee.

Willow Bend Ventures filed suit against Terry’s Resource Management, Terry Hayes and Terry’s Dirt Works in the 24th Judicial District Court on Feb. 19. Willow Bend Ventures claims it was contracted by Terry’s Resource Management to provide and transport clay earthen materials for a levee project.

The plaintiff alleges that it invoiced the defendant for $147,848.50 for materials provided for a job, but did not receive any payment until it submitted three letters of demand. Willow Bend Ventures asserts the defendant did finally make a partial payment of $11,155.94, but did not make any further payments.

The defendant is accused of breach of contract.

Damages in the amount of $136,692.56 are sought by the plaintiffs.

Willow Bend Ventures is represented by attorney Matthew D. Miller of Hattiesburg, Miss. law firm Copeland, Cook, Taylor & Bush.

The case has been assigned to Division B Judge Cornelius E. Regan.

Case no.  724-179.
