Construction company accused of mismanagement and indebtedness in lawsuit

BATON ROUGE – An East Baton Rouge Parish construction company is being sued for allegedly failing to pay a subcontractor involved in the construction of a New Orleans property.

Coker & Associates Inc. filed a lawsuit against D. Honore Construction LLC and Berkley Regional Insurance Company in the 19th Judicial District Court on Feb. 22. The plaintiff claims the defendant was the sole cause of Coker incurring significant expenses associated with demobilizing and remobilizing its crew on several occasions due to lack of construction materials and delays at the Mid-City Gardens Activity Center & Residential property. Coker alleges the defendant has failed to pay $67,862.70 in change order charges for the performance of additional work and failed to pay the retainer fee of $31,130.24 agreed upon under the subcontract agreement.

The defendant is accused of failure to submit payment and breach of contract.

The plaintiff is seeking a sum in excess of $100,000 for a retainer fee, change order charges and interest.
