Wilshire Insurance Company sued over semi accident

Mack truck 35a75

BATON ROUGE – An Baton Rouge man is suing an insurance company for damages after his 1995 Mack Truck rolled over and ejected him resulting in severe personal injury to his back.

Illlye Porter filed a lawsuit against Wilshire Insurance Company in the 19th Judicial District Court.

Porter claims he was nearly struck by an unknown driver and to avoid collision he immediately adjusted his truck which resulted in him being flung from the vehicle. He further claims that under the insurance policy he holds with the defendants for his 1995 Mack Truck includes coverage for incidents involving uninsured/underinsured motorist coverage.

Porter says that the negligent acts of the unknown driver fall under that provision and therefore Wilshire is liable to him for damages.

Attorney for the plaintiff is Gerard N. Torry of Baton Rouge.

This case has been assigned to Section 24 Judge R. Michael Caldwell.

Case no. 619311.
