Pump station subcontractor sues contractor over alleged non-payment

GRETNA – A masonry company is suing a Kenner-based contractor for unpaid subcontracting fees for work done on a pump station.

Rush Masonry Inc. filed suit against Benetech LLC and Western Surety Company in the 24th Judicial District Court on April 15.

Rush Masonry Inc. claims it entered into an agreement with Benetech to make repairs on Pump Station #6 in New Orleans. The plaintiff claims it performed all work on the project in a good, timely and workmanlike manner, but was not paid $64,459.94.

The defendant is accused of breach of contract and non-payment.

Damages in the amount of $64,459.94 are sought in addition to loss of use of funds and interest.

Rush Masonry Inc. is represented by H. Minor Pipes III of Barrasso, Usdin, Kupperman, Freeman & Sarver LLC.

The case has been assigned to Division D Judge Scott U. Schlegel.

Case no. 725-951.
