GRETNA – A Kenner woman is suing for injuries she claims to have suffered at her home in a fall off a temporary staircase erected by a home elevation company.

Lydia Cruz Marin, and husband Julio, filed suit against Rendon Construction LLC and Ramon O. Santos in the 24th Judicial District Court on April 17.  Marin claims her home located at 3629 Delaware Ave. in Kenner was in the process of being elevated under the Hazard Mitigation Grant Program by Rendon Construction on April 21, 2012 when a temporary stairway was put into place so she could access the home. The plaintiff alleges she was walking carefully and prudently when she suddenly tripped on a hazardous condition in the doorway and fell to the ground. Marin asserts she received injuries in the fall including a fracture to her pinky toe on her right foot for which she has had to undergo medical treatment.

The defendant is accused of failing to place warning signage around the hazardous condition, creating an unreasonable risk of harm and failing to warn of risk of harm.

An unspecified amount in damages is sought for pain and suffering, psychological damages, emotional damages, limitation for normal daily activities and discomfort.

Marin is represented by Gissel M. Ferriol of New Orleans-based Ferriol, Perez & Gordon LLC.

The case has been assigned to Division I Judge Nancy A. Miller.
