Car dealer sues contractor over unpaid repairs to truck and cost of rental vehicle

GRETNA – A Jefferson Parish car dealer is suing a local contractor over unpaid repairs.

Harvey Ford LLC and Don Bohn Ford Lincoln Mercury filed suit against Rick Mithun and Master Builders LLC in the 24th Judicial District Court on April 19.

Harvey Ford claims Mithun had his truck towed to its repair shop located at 37337 LaPalco Blvd. in Harvey. The plaintiff alleges that the defendant ordered a diagnostic test on the vehicle which found that the fuel was contaminated. Instead of having Harvey Ford repair the truck immediately Mithun had a State Farm agent assess the vehicle’s malfunction to see if it the problem was covered under a vehicle insurance policy, which it was not. The plaintiff asserts that during the three to four weeks it took for the insurer to deny the insurance claim and an additional three days to repair it themselves Mithun used a rental vehicle he received, but which it never agreed to let him use at no cost.

After the truck was repaired, Harvey Ford alleges that a check written for $3,749.85 written in the name of Master Builders was presented by Mithun, but that he requested a stop payment order on the check before it could be cashed. The plaintiff claims the defendant still owes for repairs done to his truck as well as for vehicle rental costs.

The defendant is accused of intentionally defrauding the plaintiff.

Damages in the amount of $3,749.85 plus penalties, court costs and attorney’s fees is sought by the plaintiff.
