Contractor seeks $143K after renovations at La Pension Resorts

NEW ORLEANS - A New Orleans company is suing a local contractor for allegedly failing to pay for work completed at a Decatur Street resort.

Boes Iron Works filed suit against Ellis Construction Inc., The LA Pension Owners’ Association Inc. and the Santropadre Condominiums Association Inc. on May 1. for failure to pay for work completed at the La Pension Resorts.

Boes Iron Works entered into a subcontract with Ellis Construction to complete work in support of a renovation of the La Pension Resort located at 115 Decatur Street in New Orleans.  After completing the work worth $143,177, Boes Iron Works was to be paid by Ellis Construction within five working days, the suit claims. La Pension Resort alleges it paid Ellis Construction for Boes Iron Works’ fees. Boes Iron Works’ claims that money has not been forwarded by Ellis Construction.

The defendant is accused of breach of contract, failing to promptly pay, misapplication of funds and unfair trade practices.

Boes Iron Works is being represented by Keith L. Magness of the Gretna-based Law Office of Keith L. Magness L.L.C.

The case has been assigned to Division L Judge Kern A. Reese.

Case No. 2013-04187.
