NEW ORLEANS -A St. Tammany Parish resident is suing a local gas station where she claims to have slipped and fell in water that overflowed onto the floor from a toilet.
Cherlyn Curtis filed suit against Lavignebaker Peroleum LLC in the Orleans Parish Central District Court on June 24.
Curtis was at the Shell gas station located on 6041 Bullard Ave. in New Orleans in July 2012 when she allegedly slipped and fell in a puddle of water in the women’s restroom. The puddle was allegedly created by an overflowing toilet. Curtis claims she suffered injuries to her ribs, knee and ankle in the incident.
The defendant is accused of negligence for failing to maintain its premises in a safe manner, failing to properly train and instruct its employees in maintaining its toilets in a safe and hazard-free manner and allowing dangerous and hazardous conditions to exists on its premises.
An unspecified amount in damages are sought for physical and mental pain and suffering, medical expenses and disability.
The plaintiff is represented by Stephen P. Bruno of the New Orleans-based Bruno & Bruno LLP.
The case has been assigned to Division A Judge Tiffany G. Chase.
