NEW ORLEANS – A New Orleans homeowner filed suit against the Sewage and Water Board of New Orleans for allegedly installing electrical panels directly outside his bedroom window and within two feet of his home, in violation of a setback variance.
Charlie Kendrick filed suit against the Sewage and Water Board of New Orleans in the Orleans Parish Civil District Court on Aug. 2.
The suit states that in late 2010 and early 2011, the board had a sewer lift station rebuilt on the corner of Morrison Road and Berg Road, adjacent to the plaintiff’s property. The plaintiff claims that the original lift station was in compliance with the setback variance from the property line between his home and the lift station.
When the lift station was rebuilt, however, the electrical panels were placed within two feet of the Kendrick property line, right outside the master bedroom window, according to the suit.
The plaintiff claims that in 2011 he began corresponding with Madeline Goddard regarding having the panels removed, but that the communications stopped after several months without resolution.
The plaintiff seeks an unspecified amount in damages for disrupted peaceful enjoyment, the lowered value of his home, and loss of privacy.
The plaintiff is represented by Michelle E. Scott-Bennett of the Justice For All Law Center LLC of New Orleans.
The case has been assigned to Division L Judge Kern A. Reese.
