GRETNA – An energy company that provided natural gas to a neighborhood is suing over the lack of home sales in a five year period to pay for the main installed.
Atmos Energy Corporation filed suit against Barataria Park LLC in the 24th Judicial District Court on Sept. 3.
Atmos Energy Corporation claims that on July 1, 2008 it entered into an agreement with Barataria Park Subdivision for the installation and distribution of natural gas. The plaintiff alleges that the defendant was to put down $60,000 for the service to be repaid via a refund for each new home built in the subdivision that became a permanent natural gas customer. Atmos Energy asserts it installed the gas main extension pursuant to the agreement and that for five years following the agreement did not seek a return of the deposit, but are now seeking the return of funds.
The defendant is accused of breach of contract.
Damages in the amount of $60,000 are sought by the plaintiff.
Atmos Energy Corporation is represented by Oscar E. Reed Jr. of Lafayette.
The case has been assigned to Division M Judge Henry G. Sullivan Jr.
