Tenant sues landlord for allegedly not making repairs to damaged rental unit after Hurricane Isaac

GRETNA – A tenant is suing his landlord who he claims did not repair the rental unit he and his family share after it was severely damaged during Hurricane Isaac.

Sean C. McGittigan filed suit against Jawad Zaini and Ideal Zone LLC in the 24th Judicial District Court on Sept. 26.

McGittigan alleges that they leased a dwelling from Zaini and Ideal Zone located at 1224 Lake Frances Drive and that after Hurricane Isaac made landfall on Aug. 28, 2012 the structure was damaged. The plaintiff claims that the residence was damaged and that the defendants did not try to correct the damage that led to further disrepair. McGittigan asserts that he and his family have been exposed to a dangerous environment by Zaini and Ideal Zone.

The defendant is accused of leaving the premises exposed to the elements, not repairing damages from an earlier hurricane, causing a less than suitable living environment for a terminally ill and disabled veteran, causing a less than suitable living environment for children, allowing water to enter and damage the property and not providing suitable air conditioning and heating.

Damages in the amount of $100,000 are sought by the plaintiff.

McGittigan is representing himself pro se in the case.

The case has been assigned to Division C Judge June Berry Darensburg.
