GRETNA – A corporate retailer is being sued by a man who was allegedly injured when a single bottle of beer fell on his foot.
Robert Holts filed suit against Wal-Mart LLC in the 24th Judicial District Court on Sept. 27.
Holts claims he was picking up a six pack of beer at the Wal-Mart located at 1501 Manhattan Blvd. in Harvey when the bottom of the container gave out and a beer fell onto his foot. The plaintiff alleges the cardboard package failed due to water that had collected on its bottom making it soggy. Holts asserts he was injured in the incident.
The defendant is accused of failing to maintain the premises in a safe condition, failing to adequately inspect and clean up the refrigerated cooler, maintaining a defective condition, failing to maintain the stock of beer so the integrity of containers would not be affected, failing to inspect and remove defective containers, permitting an unsafe condition, failing to warn of an unsafe condition and failing to enact and follow proper rules and regulations.
An unspecified amount in damages is sought for mental anguish, medical expenses, loss of income and loss of wage earning capacity.
