Lafitte homeowner and contractor sued by subcontractor over home elevation funds

Breach of contract

GRETNA – A subcontractor is suing a home elevation contractor and homeowner for allegedly not paying the full amount for a home elevation.

TMB Services LLC filed suit against E.A. Keenan LLC, Crescent City Elevations and Timothy Prestenbach in the 24th Judicial District Court on Oct. 2.

TMB Services claims that they entered into a subcontract with E.A. Keenan LLC and Crescent City Elevations to lift Timothy Prestenbach’s home located at 4948 Oak Drive in Lafitte. The plaintiff asserts that under the subcontract  it was to receive $81,000 to lift the 3,580 square foot home 2.5 feet, which would come in two payments with the first being provided when the funds were received and the second upon the completion of the contract. TMB Services alleges it only received $50,000 in payments.

The defendant is accused of breach of contract.

Damages in the amount of $30,840 are sought by the plaintiff.

TMB Services is represented by Jeffrey M. Siemssen of Metairie-based Nicaud & Sunseri LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
