NEW ORLEANS – A woman is suing the property owner that allegedly allowed a roof and ceiling to degrade to such a point that it collapsed in on her last August.

Terry Smith filed suit against Four Square Properties & Management and Lighthouse Property Insurance Corporation in the Orleans Parish Civil District Court on Aug. 16.

The plaintiff claims that on Aug. 30, 2012, she was a tenant of the defendant when, while in the kitchen of her apartment, the ceiling collapsed seriously injuring her.

The defendant is accused of failing to know the unsafe conditions of the building, failure to abide by building safety codes, failing to provide safe and appropriate areas for tenants and failing to warn/maintain the roof and ceiling of the apartment.

An undisclosed amount in damages is sought for medical expenses, mental and physical pain and suffering, loss of enjoyment of life and residual disability plus legal interest and the costs of the proceedings.

The plaintiff is represented by attorney John J. Sullivan of New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.

Case no. 2013-07767.
