GRETNA – A contractor is suing an offshore oil rig owner for allegedly improperly canceling a contract for the rental of one prebuilt structure and the construction of another for an oil rig.

B&J Martin Inc. filed suit against Nabors Offshore Corporation in the 24th Judicial District Court on Oct. 4.

B&J Martin Inc. asserts they entered into a contract with Nabors Offshore Corporation to supply a water closet for an offshore oil rig at a cost of $46,800. The plaintiff claims that the water closet was delivered to the defendant’s oil rig at which time it was rejected for purchase, but was rented for a period of nearly three months before being returned. B&J Martin Inc. alleges that after the first water closet was returned an order to build a second one was placed at which time they began pre-cutting materials even though the final layout had not been provided.

The plaintiffs assert that they were later notified that the building plans had changed and the water closet would not be needed and that the order was canceled. B&J Martin Inc. claims they provided an invoice to Nabors Offshore Corporation for $5,462.11 for the rental of the first water closet and $20,803 for the materials purchased and cut in preparation of making the second water closet. The plaintiff alleges that after defendant refused to make any payments it began to charge them a $100 a day storage fee for the parts related to the incomplete unit.

The defendant is accused of breach of contract.

Damages in the amount of $46,800 are sought by the plaintiff.
