Insurance broker sued for allegedly not reducing cost of home insurance policy due to home improvements

GRETNA – An insurance customer is suing his insurance broker for allegedly overcharging him for a number of years.

Edward M. Campbell IV filed suit against Eagan Insurance Agency Inc. and their insurer in the 24th Judicial District Court on Oct. 11.

Campbell asserts he used Eagan Insurance Agency for a number of years for all of his insurance needs. The plaintiff alleges that following Hurricane Katrina he installed numerous upgrades to his property including a hip roof, hurricane shutters, surge protection and a continuity system that should have resulted in reduced insurance premiums and credits.

Campbell claims that the premiums he paid after the improvements were approximately 26 percent higher than what he should have paid and that he should be reimbursed for that amount.

The defendant is accused of failing to provide uniform and standard guidelines for agents to properly broker insurance, failing to identify customers with enhanced portfolios, failing to perform an inspection or review of the insurance coverage, failing to re-evaluate coverage, failing to apply credits or reductions and failing to reimburse plaintiff for overpayment.

Damages in excess of $50,00 are sought by the plaintiff.

The case has been assigned to Division O Judge Ross P. LaDart.
