NEW ORLEANS— A man alleges that his landlord unlawfully evicted him from his apartment and allowed his possessions to be stolen while he was incarcerated.

Charley Robertson filed suit against Eric Hawkins in the Orleans Parish Civil District Court.

The plaintiff claims that he was leasing the defendant’s property on North Galvez Street when he was arrested and incarcerated in June. Upon his release in September, Robertson discovered he had been evicted. He alleges that he prepaid rent through September.

The defendant is accused of discarding and/or failing to secure the residence so that the plaintiff’s belongings were stolen or “converted” while he was away.

Robertson names an amount of $26,993 for his lost belongings and asks for repayment of his rent kept by the defendant. He also seeks any additional relief available for his claim.

The plaintiff is represented by Patrick H. Patrick of New Orleans-based Patrick Miller LLC.

The case has been assigned to Division J Judge Paula A. Brown.
