Petco customer seeks $50K after trip near checkout counter

NEW ORLEANS – A customer filed suit against Petco after she was allegedly injured after tripping and falling over merchandise near the checkout counter.

Norman Sinclair filed suit against Petco Animal Supplies Stories Inc. in the Orleans Parish Civil District Court.

The suit states that on May 3, 2013, the plaintiff was a customer in the Petco on Tchoupitoulas Street when he tripped over merchandise near the checkout counter. As a result of this trip and fall, the plaintiff allegedly suffered injuries to his head, neck, shoulder, hip and knees.

The defendant is accused of failing to keep a proper lookout, failing to maintain its premises in a safe and hazard-free condition, acting with indifference toward the safety of others and being otherwise negligent.

The plaintiff seeks $50,000 in damages for the aforementioned injuries as well as mental anguish, physical pain and suffering, medical expenses and lost wages.

The plaintiff is represented by Joseph M. Bruno Jr. of Bruno & Bruno of New Orleans.

The case has been assigned to Division L Judge Kern A. Reese.
