GRETNA – An area gaming company that provides video poker machines to local businesses is suing the maker of the machines for allegedly providing them with a used one that was defective.
Payback Gaming Inc. filed suit against Advanced Gaming Distributors LLC in the 24th Judicial District Court on Dec. 4.
Payback Gaming Inc. asserts they ordered a used video gaming device from Advanced Gaming Distributors for $8,995 on Aug. 8, 2011. The plaintiff claims the device failed after delivery and provided an error message for which they called numerous times for services, but were only able to have fixed temporarily. Payback Gaming Inc. alleges that it was not until July 23 that it was determined the machine had a defective circuit board placed in it after being refurbished.
The plaintiff asserts the defendant misrepresented the condition of the machine to conceal the defect.
The defendant is accused of breach of contract, fraud, intentional misrepresentations and unfair trade practices.
An unspecified amount in damages is sought for return of purchase price, punitive damages and attorney’s fees.
Payback Gaming Inc. is represented by attorney Michael J. Laughlin of Metairie.
The case has been assigned to Division B Judge Cornelius E. Regan.
