Convenience store owners sued by gas station chain who claims they copied store design

GRETNA – A gas station chain is suing a local competitor it claims copied the look and fell of their store in order to confuse customers into thinking they were associated with one another.

Brothers Petroleum LLC filed suit against Imad “Tony” Abdel-Majid, Raed “Ricky” Othman Abdel Majeed and Jimmy’s Discount Meat Market Inc. in the 24th Judicial District Court on Jan. 10.

Brothers Petroleum alleges that a competing convenience store located at 1055 Whitney Ave. in Gretna set up by Abdel-Majid, Majeed and Jimmy’s Discount Meat Market Inc. made an effort to make their store look like a Brothers location by requesting similar signage, store layouts and trade dress from contractors. The plaintiff claims that the defendant infringed upon their trade name, color scheme, design, logos and interior and exterior design.

The defendant is accused of attempting to mislead, imitating their business operation and violating the Louisiana Unfair Trade Practices Act and Consumer Protection Law.

An unspecified amount in damages is sought for irreparable injury, loss of plaintiffs’ good will, loss of profits, as well as a permanent injunction requiring the store to discontinue the emulation of their store look and feel.

Brothers Petroleum is represented by in-house attorney Joseph V. Dirosa Jr. of Metairie.

The case has been assigned to Division B Judge Cornelius E. Regan.
