GRETNA – A woman who claims a home sale was fraudulently completed by someone pretending to be her is suing the home’s former co-owner and the owners they sold it to as well as a couple that currently owns the property.
Wanda Schultz filed suit against Melvin Shultz Jr., Louisiana Home Help LLC, Courtney Hidalgo, Hugo Pineda and Maria Pineda in the 24th Judicial District Court on Feb. 18.
Schultz alleges that she was the victim of a fraudulent transaction in which Shultz had an unidentified woman with falsified identification documents forge her signature in front of a notary public to sell her home located at 798 Terry Parkway in Gretna for $93,000 to Louisiana Home Help LLC who in turn sold it to the Pinedas. The plaintiff claims that the transaction occurred on June 11, 2010 and that since August 10, 2011 she has been deprived of rightful ownership of her property, which is now in the possession of the Pinedas.
The defendant is accused of vice of consent due to fraud, violation of state law, fraudulent alienation of co-owned property and unauthorized possession of property by another owner.
An unspecified amount in damages is sought for financial loss, emotional pain and suffering, loss of property and attorney’s fees.
Schultz is represented by Myles Steib of Metairie-based Gardner & Steib.
The case has been assigned to Division E Judge John J. Molaison Jr.
Case no. 735-600.
