GRETNA – A local builidng owner and elevator company are being sued by a woman who claims she was injured in a fall when stepping out of an elevator that did properly align with the floor where it was stopped.
Lois Simon filed suit against Colony Specialty Insurance Company, FAJ LLC, Schindler Elevator Corporation, Jero Properies Inc. and American Crescent Elevator Corporation in the 24th Judicial District Court on March 12.
Simon alleges that she was employed by People’s Health who held an office located at 2000 Belle Chasse Highway in Terrytown owned by FAJ LLC whose elevator system was maintained by Schindler Elevator Corporation. The plaintiff claims she was riding in the elevator on April 15, 2013 when it came to a stop where she was to get off, however, the elevator did not properly align with the floor causing her to trip while exiting. Simon asserts she received significant injuries in the incident.
The defendant is accused of failing to properly maintain the elevator, failing to maintain and replace defective elevator parts, failing to appropriately inspect and maintain the elevator, failing to warn users of the elevator's defects and failing to post appropriate inspection certifications.
An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical expenses, impairment of earning capacity, loss of enjoyment of life, disfigurement and disability.
