Delivery driver suing sandwich shop over tripping injury

GRETNA – A delivery driver is suing restaurant she was making a delivery to when she allegedly was injured after stepping into a drain.

Heather Doell filed suit against Da Fa Real Food Services LLC, Roly Poly and their insurers in the 24th Judicial District Court on April 25.

Doell claims that on Dec. 27, 2013 she was a making a delivery at the Roly Poly sandwich shop located at 1640 Hickory Ave. in Harahan when she walked into a walk-in cooler and stepped into an improperly placed drain. The plaintiff asserts that she fractured her left ankle in the incident and that two managers were present at the time. Doell alleges that she has had to undergo medical treatment and may need surgery.

The plaintiff claims that on Feb. 9 she was fired even though she had attempted to work between the date of her injury and that time.

The defendant is accused of having a defect in its building and maintaining a defective premises.

An unspecified amount in damages is sought for loss of wages, pain and suffering, medical expenses, mental aguish, embarrassment and wrongful termination.

Doell is represented by J. Michael Daly of Metairie-Walker Daly LLP.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
