GRETNA – The owners of an apartment building that was damaged in a fire are suing over the estimate provided by their property insurer.
Edward R. and Diane S. Drury filed suit against underwriters at Lloyds London and Atlantic Specialty Lines Inc. in the 24th Judicial District Court on May 2.
The Drurys alleges that they were the owners of two rental units located at 817 and 819 27th St. in Kenner, which both sustained damages.
The plaintiffs assert that on May 9, 2013 a tenant in 819 27th St. left a pot of food cooking on the stove which caught the kitchen wall on fire and heavily damaged the apartment as well as the adjoining unit at 817 27th St. The Drurys claim that the adjuster sent by the defendant undervalued the property and never provided them with the results of an estimate and that they only received a check on July 3, 2013 in the amount of $48,108.72. Following the payment the plaintiffs allege the home has still not been fully repaired.
The defendant is accused of breach of contract.
An unspecified amount in damages is sought for full repairs needed.
The Drurys are represented by Edward R. Drury pro se.
The case has been assigned to Division O Judge Ross P. LaDart.
