Bayou Segnette camp subcontractor sued over alleged non-payment of materials

Breach of contract

GRETNA – A concrete product fabricator is suing a local construction company for non-payment of materials it provided for work as a subcontractor on a public bid project.

Harris Rebar Nufab LLC filed suit against True Wall Enterprises LLC, Troy Andrew Frick, Lamaison Builders SW LA and Star Insurance Company in the 24th Judicial District Court on May 8.

Harris Rebar Nufab claims it provided material including fabricated rebar to True Wall under an Oct. 19, 2012 proposal in connection with a camp being constructed at Bayou Segnette State Park. The plaintiff asserts that in exchange for providing the materials through delivery to True Wall it should have been paid $29,043.68, but that the amount in question was never provided to them.

The defendant is accused of breach of contract, claim on open account, unjust enrichment and claim against payment bond.

An unspecified amount in damages is sought for actual damages, penalty payment, interest, costs of court, trial by jury fees and attorney’s fees.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
