CVS Pharmacy sued on claims of falsely imprisoning teen accused of shoplifting

GRETNA – CVS Pharmacy Inc. is being sued by the parents of a teenage girl they claim was wrongfully detained and searched after being wrongfully accused of shoplifting.

Robin Spencer, individually and on behalf of her minor child, filed suit against CVS Pharmacy Inc., Louisiana CVS Pharmacy LLC and Jennifer Ludwizki in the 24th Judicial District Court on May 16.

Spencer alleges her daughter was shopping at the CVS Pharmacy located at 2105 Cleary Ave. in Metairie when she found she was being stalked in the store by a woman in men’s clothing and after becoming frightened attempted to leave the store when she was stopped by Ludwizki, a security guard, who allegedly never identified herself as a CVS employee. The plaintiff claims that her daughter was detained and her purse was searched and even after it was determined she had not stolen anything from the store she was held in a room with Ludwizki against her will and without the consent of her parents.

The defendant is accused of negligent hiring, failing to properly train employees, failing to properly supervise employees, false imprisonment, holding a minor child without cause, use of excessive force and intentional infliction of emotional distress and mental anguish.

An unspecified amount in damages is sought for mental pain and suffering, mental anguish, emotional distress, humiliation, embarrassment and inconvenience.

Spencer is represented by Patrick B. Sanders of the Gretna-based Law Office of John W. Redmann LLC.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
