GRETNA – A local contractor has been named in a lawsuit for allegedly trespassing and causing damage to a piece of property located next to a work site.

Kirk Prest, Denise Prest and Fin & Feather Chalets Inc. filed suit against Chet Morrison Contractors LLC in the 24th Judicial District Court on June 13.

The Prests and Fin & Feather Chalets assert that Chet Morrison Contractors were contacted by them in late June and early July 2013 and were granted limited permission to be present on their property located at 38920 Highway 23 in Boothville for the purpose of fulfilling a contract at a nearby property. The plaintiffs claim that the defendants unlawfully trespassed on their property with a heavy excavator, semi trucks and other heavy machinery despite having access to the property via a nearby pipeline right of way.

The Prests and Fin & Feather Chalets claim the trespassing has resulted in extensive property damage.

The defendant is accused of trespassing and property damage.

An unspecified amount in damages is sought for reasonable cost of repair and restoration, loss of business and economic income, difference in the value of property before and after damage, present property damage and court and litigation costs.

The plaintiffs are represented by Patrick B. Sanders of the Gretna-based Law Office of John W. Redmann LLC.

The case has been assigned to Division I Judge Nancy A. Miller.
