NEW ORLEANS – A construction worker has filed suit after a scaffolding alleged collapsed above him, which he claims resulted in severe injuries due to the negligence of his employer.

Franklin Gabriel Suriel-Arzuaga filed suit against Drury Southwest Inc, Encos Inc. and Insulations Inc. in the Orleans Parish Civil District Court on June 10.

Suriel-Arzuaga alleges the scaffolding collapsed and caused him multiple injuries. The plaintiff asserts that had the defendants used the appropriate standard of care the accident would not have occurred.

The defendants are accused of using unapproved scaffolding boards, failing to replace unapproved scaffolding boards, failing to maintain a reasonably safe area, failure to train its employees, reckless endangerment, failing to correct a dangerous condition that the defendants knew of and failing to report OSHA violations.

The plaintiff is seeking an unknown amount in damages for loss of enjoyment of life, physical disability, pain and suffering, mental anguish, disruption of bodily tissues and medical expenses.

Franklin Gabriel Suriel-Arzuaga is represented by Ron A. Austin from the firm of Austin & Associates LLC in Harvey.

The case has been assigned to Division F Judge Christopher J. Bruno.
