GRETNA – Jefferson Parish is being sued by a local couple after a tree was allegedly wrongfully removed from the front of their home.

Robert E. Howard III and Kathryn A. Howard filed suit against in the 24th Judicial District Court on July 2.

The Howards contend that an American elm tree located on their property between the sidewalk and street in front of their home located at 1106 Division St. in Metairie was removed by Jefferson Parish workers without their consent. The plaintiffs claim that the tree was healthy at the time of its removal and that they objected to its removal, but that the tree was moved due to complaints by their neighbor. The Howards say the tree presented no danger to people or property and they were never given a chance to have the tree looked at by an arborist before its removal.

The plaintiffs assert the removal of the tree was in violation of parish ordinances.

The defendant is accused of violation of parish law.

An unspecified amount in damages is sought for property damage, diminution in plaintiff’s property, loss of use of tree, loss of enjoyment of property, aggravation and mental anguish.

The Howards are represented by R. Todd Musgrave of New Orleans-based Musgrave, McLachlan & Penn LLC.

The case has been assigned to Division D Judge Scott U. Schlegel.
