NEW ORLEANS – A building owner claims his roof was used as a staging area by contractors who unlawfully trespassed onto his roof and caused damage.
Shabtai Perl filed suit against Medallion Building Condominim Owners Association Inc., Scottsdale Insurance Company, Acadian Waterproofing& General Maintenance and RLA Construction in the Orleans Parish Civil District Court on July 7.
Perl claims the defendants used his roof as a staging area to work on the adjacent building, which caused damage to his roof. The plaintiff asserts the defendant, Medallion Building Condominium Owners Association, hired the other defendants Acadian and RLA to perform construction on the Medallion building. Perl alleges that the hired contractors unlawfully and intentionally trespassed onto the roof of his building doing damage to his property in order to minimize their costs. The plaintiff claims that the defendants have refused to cooperate in covering the cost of repairing the roof to its original condition.
The defendants are accused of unlawfully trespassing onto the plaintiff’s property and causing damage they are liable for.
The plaintiff is seeking an unknown amount in damages for the reasonable cost of repair and restoration, mental anguish, distress and inconvenience.
